By using RangeSight with RangeIQ technology, you acknowledge and agree to the following legally binding terms. If you do not agree to these terms, do not use this application.
1. "AS-IS" WARRANTY DISCLAIMER
RANGESIGHT AND RANGEIQ ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Accuracy, reliability, or completeness
- Non-infringement of third-party rights
- Uninterrupted or error-free operation
- Freedom from viruses or harmful components
WE DO NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING the accuracy, completeness, reliability, suitability, or timeliness of any calculations, predictions, weather data, maps, battery estimates, range projections, or any other information provided by RangeSight.
2. NO GUARANTEE OF ACCURACY
While RangeSight utilizes the proprietary RangeIQ AI algorithm, real-time weather data, physics-based models, and multi-factor environmental analysis, WE MAKE NO REPRESENTATIONS OR WARRANTIES regarding the accuracy of any output. Actual flight performance WILL VARY due to numerous factors including but not limited to:
- Rapidly changing weather and environmental conditions
- Wind gusts, microbursts, and localized weather phenomena
- Battery degradation, health, temperature, and charge cycles
- Aircraft maintenance condition and firmware versions
- Payload weight and aerodynamic effects
- Pilot technique, flight patterns, and maneuvers
- GPS accuracy, signal quality, and satellite availability
- Electromagnetic interference and radio frequency disruption
- Altitude, terrain effects, and air density variations
- Propeller condition and motor efficiency
- Temperature effects on electronics and battery chemistry
- Manufacturer specification variances
3. ASSUMPTION OF RISK
YOU ASSUME FULL AND COMPLETE RESPONSIBILITY for all risks associated with drone operation. You are SOLELY RESPONSIBLE for:
- Compliance with all applicable laws, regulations, and aviation rules
- Obtaining all required licenses, certifications, and authorizations
- Airspace awareness, authorization, and no-fly zone avoidance
- Pre-flight inspections and equipment airworthiness checks
- Real-time weather assessment and monitoring during flight
- Equipment condition, maintenance, and serviceability
- Maintaining visual line-of-sight (where legally required)
- Collision avoidance with manned aircraft, people, and obstacles
- Safe operation and emergency procedures
- All flight decisions and go/no-go determinations
- Return-to-home planning and contingency procedures
RangeSight is a planning aid ONLY. It DOES NOT replace proper pilot judgment, training, certification, real-time situational awareness, or manual control capability. NEVER rely solely on RangeSight for safety-critical decisions.
4. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPERS, OWNERS, OPERATORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS OF RANGESIGHT, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES, SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:
- Direct damages - equipment damage, drone loss, repair costs
- Indirect damages - business interruption, lost opportunities
- Incidental damages - costs arising from use or inability to use
- Consequential damages - downstream effects of any incident
- Special damages - unique circumstances or losses
- Punitive or exemplary damages - regardless of cause
- Personal injury or death - to you or any third party
- Property damage - to your property or third-party property
- Data loss - flight logs, settings, or any stored information
- Regulatory fines or penalties - from aviation authorities
- Airspace violations - and resulting consequences
- Privacy violations - arising from drone operations
- Third-party claims - of any nature whatsoever
- Legal fees and costs - associated with any claims
This limitation applies WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), WARRANTY, OR ANY OTHER LEGAL THEORY, arising out of or related to your use or inability to use RangeSight, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES .
IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
5. INDEMNIFICATION
You agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the developers, owners, operators, affiliates, licensors, service providers, and their respective officers, directors, employees, agents, and representatives from and against ANY AND ALL claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees and court costs) arising from or related to:
- Your use or misuse of RangeSight
- Your drone operations and flight activities
- Your violation of any applicable laws, regulations, or ordinances
- Your violation of these terms or any other RangeSight policies
- Any third-party claims arising from your drone operations
- Personal injury or property damage caused by your drone
- Privacy violations or unauthorized surveillance
- Airspace violations or interference with manned aircraft
- Any negligent or wrongful conduct by you
6. REGULATORY COMPLIANCE
YOU ARE SOLELY RESPONSIBLE for knowing and complying with ALL applicable drone laws and regulations in your jurisdiction, including but not limited to:
- United States: FAA Part 107, Part 89 (Remote ID), recreational flying rules, airspace authorizations (LAANC), TFRs, NOTAMs
- European Union: EASA regulations, national aviation authority rules, U-space requirements
- Other jurisdictions: Transport Canada, UK CAA, CASA (Australia), and all other applicable regulatory bodies
- Local ordinances: State, provincial, municipal, and local laws restricting drone operations
Regulatory requirements include but are not limited to:
- Drone registration and marking requirements
- Pilot certification and licensing (Part 107, A2 CofC, etc.)
- Remote ID broadcast requirements
- Airspace restrictions and no-fly zones
- Altitude limits and distance restrictions
- Visual line-of-sight requirements
- Operations over people and moving vehicles
- Night operations requirements
- Insurance requirements
Regulations vary by jurisdiction and change frequently. Always verify current requirements with your local aviation authority before every flight. Failure to comply may result in civil penalties, criminal prosecution, or both.
7. NOT PROFESSIONAL ADVICE
RangeSight DOES NOT provide and should not be construed as providing:
- Professional aviation consulting or flight planning services
- Certified meteorological services or weather forecasting
- Legal advice regarding aviation regulations or compliance
- Safety certification or airworthiness determination
- Professional engineering or technical consultation
- Risk assessment or safety management services
The application is intended for informational and educational purposes only. You should consult with qualified professionals regarding flight operations, weather assessment, regulatory compliance, and safety procedures. DO NOT rely solely on RangeSight for mission-critical or safety-critical decisions.
8. INHERENT RISKS OF DRONE OPERATION
Drone operation carries inherent and unavoidable risks including but not limited to:
- Equipment failure, malfunction, or defects
- Battery depletion, failure, or fire
- Loss of control signal or GPS lock
- Flyaways and loss of aircraft
- Collisions with obstacles, aircraft, or people
- Crashes and uncontrolled descents
- Adverse weather conditions and sudden weather changes
- Electromagnetic interference
- Software bugs and firmware issues
- Human error and pilot mistakes
NO PLANNING TOOL CAN ELIMINATE THESE RISKS. You acknowledge these inherent risks and accept full responsibility for all consequences of your drone operations. ALWAYS maintain manual control capability, visual contact (where required), and real-time situational awareness.
9. THIRD-PARTY DATA AND SERVICES
RangeSight utilizes third-party data sources and services including but not limited to:
- Weather data providers (OpenWeatherMap and others)
- Map tile providers (OpenStreetMap, Esri, CartoDB, satellite imagery providers)
- Geolocation services
WE ARE NOT RESPONSIBLE for the accuracy, availability, reliability, timeliness, or legality of third-party data or services. Third-party services are subject to their own terms of use and privacy policies. Internet connectivity is required for certain features; we are not liable for connectivity failures, service interruptions, or data transmission errors.
10. NO MANUFACTURER AFFILIATION
RangeSight is an independent third-party application and is NOT affiliated with, endorsed by, sponsored by, or officially connected with DJI, Autel Robotics, Skydio, Parrot, or any other drone manufacturer. All product names, logos, brands, and trademarks mentioned are the property of their respective owners. Equipment-specific parameters are based on publicly available specifications and may not reflect your specific hardware configuration, firmware version, aftermarket modifications, or actual operational condition.
11. SEVERABILITY
If any provision of this Disclaimer is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.
FINAL ACKNOWLEDGMENT
BY USING RANGESIGHT, YOU CONFIRM THAT YOU:
- Have read, understood, and agree to ALL terms in this Disclaimer
- Accept ALL risks associated with drone operation
- Will comply with ALL applicable laws and regulations
- Understand that RangeSight is a planning aid only, not a safety system
- Acknowledge that the developers have NO LIABILITY for any damages
- Will not hold RangeSight responsible for any flight outcomes
